Legal framework
Law of 29 July 1881 on the freedom of the press
- Article 9 of the French Civil Code
- Law on Confidence in the Digital Economy (LCEN)
- Digital Services Act (DSA)
The Law of 29 July 1881 punishes defamation and insult, while Article 9 of the Civil Code protects privacy and image rights. The liability of hosting providers and platforms is governed by the Law on Confidence in the Digital Economy and the Digital Services Act.
In press matters, the limitation period is in principle three months from publication: it is therefore important to act without delay.
